A federal jury has found an Eagle Butte man guilty of Aggravated Sexual Abuse of a Child, Sexual Exploitation of Child and Possession of Child Pornography.
According to the United States Attorney’s Office for South Dakota, the charges against 41-year-old Dustin Red Legs carry a mandatory minimum penalty of 30 years, with a maximum penalty of up to life in federal prison. Red Legs may also have to pay a $750,000 fine and be on supervised release for the rest of his life, if granted parole.
The charges date back to September 24, 2018, when Red Legs was staying at a home in Eagle Butte. He went into a room where two children were sleeping where he sexually assaulted and took sexually explicit photographs of the 10-year-old female victim.
A pre-sentence investigation was ordered and a sentencing date was set for October 26, 2020. The Red Legs was remanded to the custody of the US Marshals Service.
