SIOUX FALLS, S.D. (AP) — Billionaire banker and philanthropist T. Denny Sanford plans to ask the South Dakota Supreme Court to bar the release of affidavits used to issue search warrants into a child pornography investigation. The notice came after Judge James Power refused to first release the affidavits to Sanford’s legal team before they became public. Sanford attorney Stacy Hegge argued they couldn’t evaluate whether to appeal unless they reviewed the documents. The Sioux Falls Argus Leader and ProPublica have been working to get the documents for two years. After Sanford’s lawyers said they would meet Monday’s deadline to appeal, Power said he would keep the documents sealed until Sanford has exhausted all appeals. He has not been charged. The 86-year-old Sanford is worth an estimated $3.4 billion.

SIOUX FALLS, S.D. (AP) — A Minnehaha County judge has ruled that there is no basis to keep documents related to the child pornography investigation of banker and philanthropist T. Denny Sanford sealed. Judge James Power said in his opinion filed Thursday (June 16, 2022) that the affidavits which supported the search warrants in the investigation should be made public under South Dakota law, but he will keep them sealed until Sanford and his attorneys decide whether to appeal the ruling to the state Supreme Court. The South Dakota attorney general’s office declined to file charges following the investigation, saying it found no “prosecutable offenses” within the state’s jurisdiction.

SIOUX FALLS, S.D. (AP) — A South Dakota judge has delayed the release of affidavits in the child pornography investigation of banker and philanthropist T. Denny Sanford. Minnehaha County Judge James Power said in an email to the Sioux Falls Argus Leader Tuesday (May 31, 2022) that the affidavits would remain sealed until parties in the case seeking to unseal them have a chance to submit written briefs. Affidavits are submitted by law enforcement officers when they ask judges to issue search warrants. Sanford attorney Stacy Hegge asked Power in an email Monday to keep the affidavits sealed or at least be given additional time to seek relief from the South Dakota Supreme Court. The delay comes after the attorney general’s office said Friday it would not file charges in the case.

SIOUX FALLS, S.D. (AP) — The South Dakota attorney general’s office is not charging billionaire and philanthropist T. Denny Sanford with any crimes following an investigation into the potential possession of child pornography. The state prosecutor’s decision was made public in a court filing Friday (May 27, 2022). Sanford is a philanthropist who made his fortune in banking, and has given billions to hospitals, universities and charities. South Dakota investigators in 2019 began searching his email account, as well as his cellular and internet service providers, for possible possession of child pornography. Sanford’s lawyer has said the investigation revealed that his client’s email accounts were hacked. The Department of Justice declined to comment when asked if Sanford remains under federal investigation.
