South Dakota Gov. Kristi Noem has issued an executive order saying she directed the state’s Highway Patrol Superintendent to file a lawsuit challenging the constitutional amendment approved by voters in November that legalizes recreational marijuana in the state.
The executive order puts the authority of the Governor behind Col. Rick Miller’s effort to overturn the constitutional amendment because he was acting on behalf of the Republican governor.
Lawyers defending the constitutional amendment had argued that Miller did not have legal standing to sue and asked a South Dakota judge to dismiss the case.
Pennington County Sheriff Kevin Thom is named with Miller in bringing the lawsuit.
