JANUARY 30, 2024:
A judge has suspended a two-year prison term for a 22 year old man from Pierre who plead guilty to an aggravated eluding charge.
As part of a plea agreement, Dustin Scott Marshall, II, will be on probation for three years and must abide by various conditions given to him by the judge. Among those conditions are payment of $1000 in restitution to the City of Pierre, payment of $6300 in restitution to a private citizen, payment of various court costs and court appointed attorney fees and continuing to report for the 24/7 program.
The aggravated eluding charge came from a pursuit with law enforcement agencies back in September 2023 (Sept. 23, 2023, 10:58pm CT). A South Dakota Highway Patrol trooper attempted to stop a 2011 GMC Terrain driven by Marshall, but he did not stop and a pursuit ensued through various parts of Pierre. At one point, Marshall went down a street and crashed into a Pierre Police Department vehicle. He fled on foot, but was apprehended a short time later. No one was injured.
SEPTEMBER 25, 2023:
Charges are pending against a 22 year old man from Pierre following a pursuit with local law enforcement agencies Saturday night (Sept. 23, 2023, 10:58pm CT) in Pierre.
Information from the South Dakota Highway Patrol says a trooper attempted to stop a 2011 GMC Terrain driven by Dustin Marshall. Marshall did not stop and a pursuit ensued through various parts of Pierre. At one point, Marshall went down a street and crashed into a Pierre Police Department vehicle. He fled on foot, but was apprehended a short time later. No one was injured.
The incident remains under investigation. Agencies responding to the incident were the South Dakota Highway Patrol, the Pierre Police Department and the Hughes County Sheriff’s Office.
