FEBRUARY 2, 2024:
A 53 year old man from Pierre charged with a misdemeanor and two Class 5 felonies was sentenced to a term in the state penitentiary today (Feb. 2, 2024) in court in Pierre.
Assistant Attorney General Jessica LaMie, who prosecuted the case for the state, says Henry Jacobsen will get credit for the 332 days he’s been in the Hughes County Jail.
The charges stem from a March 7, 2023, incident where Jacobsen barricaded himself in his home in the Spring Creek area approximately 15 miles north of Pierre. The situation was first reported at 5:30 that morning. He surrendered to law enforcement six hours later (11:32am).
LaMie says Jacobsen hasn’t taken responsibility for his actions that day.
LaMie agreed with the judge that it’s lucky no one was killed.
Although the Simple Assault Domestic Violence charge is a misdemeanor, LaMie says the mental, physical and emotional injuries to the victim are serious.
Jacobsen was also ordered to pay restitution and associated court costs, among other stipulations determined by the court. Custody of Jacobsen will be turned over to the South Dakota Department of Corrections so he can begin serving his sentence.
DECEMBER 18, 2023:
A Pierre man charged with two counts of Aggravated Assault of a Law Enforcement Officer and one count of Simple Assault Domestic Violence entered pleas Monday (Dec. 18, 2023) at the Hughes County Courthouse.
Henry Jacobsen plead “no contest” to the Aggravated Assault charges which specifically refer to actions taken against Pierre Police Officer Zachery Bruzelius and Highway Patrol Trooper Mike Dale.
On the Simple Assault charge, Jacobsen took exception to the use of the word “intentionally” in reference to the argument he was having with his girlfriend, identified as “SK,” who received minor injuries after he pushed her and she fell and hit her head. After a brief recess, Assistant Attorney General Jessica LaMie filed new paperwork changing the verbiage on the charge to “recklessly.” Jacobsen then plead “guilty.”

The Aggravated Assault charges each carry a possible maximum penalty of 25 years in the state penitentiary, a $50,000 fine or both. The Simple Assault charge carries a maximum penalty of one year in the county jail, a $2000 fine or both.
A pre-sentence investigation was ordered. Sentencing was set for Feb. 2, 2024, at 1pm. Jacobson remains in the Hughes County Jail on a $40,000 cash bond.
Agencies responding included the U.S. Marshals Service, FBI, South Dakota Highway Patrol, Pierre Police Department, Hughes County Sheriff’s Office, Sully County Sheriff’s Office and American Medical Response ambulance service.
MARCH 8, 2023:
A 52 year old man from Pierre is scheduled to make an initial court appearance tomorrow (March 9, 2023) after barricading himself in a home in the Spring Creek area north of Pierre yesterday (March 7, 2023).
Information from the South Dakota Attorney General’s Office says the incident involving Henry Jacobsen was first reported at 5:30am at a home on Spring Creek Drive (15 miles north of Pierre). He surrendered to law enforcement six hours later (11:32am).
Jacobsen has been charged with Aggravated Assault Domestic Violence. The incident is still under investigation, so additional charges could be forthcoming. His initial court appearance will be held in Hughes County Circuit Court in Pierre.
South Dakota Attorney General Marty Jackley says the officers involved played an important role in keeping this situation from escalating further. Other agencies responding included the U.S. Marshals Service, FBI, South Dakota Highway Patrol, Pierre Police Department, Hughes County Sheriff’s Office, Sully County Sheriff’s Office and American Medical Response ambulance service.
