South Dakota Governor Kristi Noem isn’t commenting on a request from the state Attorney General’s Office to drop a lawsuit over recreational marijuana.
The lawsuit challenges the result of last month’s (Nov. 3, 2020) general election where more than 225,000 South Dakotans (54%) approved Amendment A, legalizing recreational marijuana in the state.
Court documents filed last week ask the court to toss out the lawsuit in its entirety. The paperwork argues the lawsuit, as filed is, is without merit and the voter decision should stand.
The suit was filed by State Highway Patrol Superintendent Col. Rick Miller and Pennington County Sheriff Kevin Thom.
