SEPTEMBER 2022:
A federal judge has decided the punishment for a 29 year old Kyle man convicted of Second-Degree Murder.
Stetson Eagle Elk was sentenced to 18 years in federal prison, followed by three years of supervised release, and ordered to pay a $100 special assessment to the Federal Crime Victims Fund.
The conviction stems from Eagle Elk, along with Gary Little Bull, shooting and killing Todd Little Bull in August 2016 in Kyle.
The investigation was conducted by the FBI and the Oglala Sioux Tribe Department of Public Safety.
Eagle Elk was immediately remanded to the custody of the U.S. Marshals Service.
JANUARY 2022:
Two men from Kyle, South Dakota, have been charged in federal court with First Degree Murder.
28 year old Stetson Eagle Elk and 29 year old Gary Little Bull, Jr., both pled not guilty.
The charges stem from Eagle Elk and Little Bull shooting and killing Todd Little Bull in August 2016 in Kyle.
The maximum penalty upon conviction is mandatory life in federal prison and/or a $250,000 fine, and $100 to the Federal Crime Victims Fund. Restitution may also be ordered.
The investigation is being conducted by the Federal Bureau of Investigation and the Oglala Sioux Tribe Department of Public Safety. Assistant U.S. Attorney Benjamin Patterson is prosecuting the case.
Eagle Elk and Little Bull were detained pending a preliminary hearing on the charges.
