RAPID CITY, S.D. (AP) – A Colorado man who said he was delivering hemp to Minnesota when he was arrested in South Dakota this summer has now been indicted by a grand jury after his load was tested for THC, the high-giving component in marijuana.
Forty-one-year-old Robert Herzberg of Red Feather Lakes faces charges of intending to distribute marijuana and possessing more than 10 pounds (4.5 kilograms) of the drug.
Herzberg told a state trooper he was delivering 300 pounds (136 kilograms) of hemp from Colorado to Minneapolis when he was pulled over July 16 on Interstate 90 for driving 86 mph in an 80 mph zone.
The Minnesota Hemp Association and the Colorado man who hired Herzberg to deliver the product both told the Rapid City Journal that Herzberg was delivering hemp – not marijuana – to a CBD-oil processing company in Minnesota.
