SEPTEMBER 2022:
An Eagle Butte man convicted of Assault Resulting in Serious Bodily Injury was sentenced by a federal court judge.
Melvin Semon, age 55, must spend 15 months in federal prison, followed by three years of supervised release, and ordered to pay a special assessment to the Federal Crime Victims Fund in the amount of $100.
Court information says on the evening of January 3, 2022, Semon became angry with the victim in their Eagle Butte home. He hit her and threw her against the kitchen chairs or table, breaking her right arm. Rather than assisting her, he departed. Responding officers found the victim sitting on the kitchen floor, crying and clutching her right arm. She required extensive reconstructive surgery to reset the bone and will likely never regain full function of her arm.
This case was investigated by the Cheyenne River Sioux Tribe Law Enforcement Services. Assistant U.S. Attorney Carl Thunem prosecuted the case.
Semon was immediately remanded to the custody of the U.S. Marshals Service.
APRIL 2022:
An Eagle Butte man has been indicted by a federal grand jury for Assault with a Dangerous Weapon, Domestic Violence by an Habitual Offender, and Assault Resulting in Serious Bodily Injury.
55 year old Melvin Semon pled not guilty.
The Indictment alleges that on April 30, 2019, and January 3, 2022, in Eagle Butte, Semon committed domestic assault. Semon committed the first assault with a dangerous weapon; the second assault resulted in serious bodily injury to his intimate partner. At the time of the assault, Semon had at least two prior convictions of offenses that would have been, if subject to federal jurisdiction, assaults against a spouse or intimate partner.
The maximum penalty upon conviction is up to 10 years in custody and/or a $250,000 fine, three years of supervised release, and $100 to the Federal Crime Victims Fund. Restitution may also be ordered.
The investigation is being conducted by the Cheyenne River Sioux Tribe Law Enforcement Services.
Semon was remanded to the custody of the U.S. Marshals Service pending hearing.
