SIOUX FALLS – A federal judge in Sioux Falls has issued a preliminary injunction ordering the Sioux Falls School District to not follow through on its plan to eliminate its gymnastics program and sell equipment.
U.S. District Judge Charles Kormann issued the order last Friday.
One dozen female athletes, ranging in age from 6 to 16, allege that the district was in violation of federal equal opportunity law, or Title IX, when it decided earlier this year to defund the gymnastics program.
Superintendent Jane Stavem, in an affidavit, claimed that the district has an obligation in its “fiscal management of public funds” and that various factors, none of which had to do with a denial of participation due gender, went into the decision to eliminate the program.
A trial date has not been set.
