JUNE 2022:
A federal judge has determined the punishment for a 40 year old man from Fort Pierre convicted of Sexual Exploitation of a Child.
James Cadwell was sentenced to 28 years in federal prison, followed by seven years of supervised release, and must pay a special assessment to the Federal Crime Victims Fund in the amount of $100.
The conviction stemmed from an incident that occurred on October 26, 2020, in Pierre when the minor victim was in Cadwell’s care. Cadwell knowingly persuaded, induced, enticed and coerced the minor victim to engage in sexually explicit conduct for the purpose of recording such conduct, and said recordings were produced by mobile phone and shared by computer.
This case was investigated by the FBI, the Pierre Police Department, the South Dakota Division of Criminal Investigation and the South Dakota Internet Crimes Against Children Task Force.
Cadwell was immediately turned over to the custody of the US Marshals Service.
DECEMBER 2020:
A 39-year-old man from Fort Pierre has been indicted by a federal grand jury for Sexual Exploitation of a Child; Distribution of Material Involving the Sexual Exploitation of Minors; and Possession of Child Pornography.
James Cadwell pled not guilty.
The Indictment alleges that on October 26, 2020, Cadwell knowingly produced, distributed and possessed child pornography.
The maximum penalty if convicted is a mandatory minimum of 15 years up to 30 years in federal prison and/or a $250,000 fine, 5 years up to life of supervised release and restitution may be ordered.
Cadwell was remanded to the custody of the US Marshals Service pending trial. A trial date has not been set.
