NOVEMBER 1, 2022:
A 38 year old rural Harrold man plead guilty in Stanley County Court today (Nov. 1, 2022) to Aggravated Eluding, 1st Offense DUI and habitual offender information.
4th Offense DUI and some misdemeanor charges against Fabian Wayne Howe, Jr., were dropped as part of a plea agreement.
The charges against Howe, Jr., are from a Feb. 1 high speed chase in Stanley and Hughes counties before ending at the border of the Crow Creek Reservation.
Stanley County States Attorney Tom Maher says a South Dakota Highway Patrol Trooper encountered Howe, Jr., at a sobriety checkpoint in Stanley County. The trooper noticed signs of, and the odor of, alcohol. Howe, Jr. then rolled up his window and disobeyed orders to stop. He proceeded into Pierre reaching a speed of 70mph, driving the wrong way on a one-way and failing to stop for stop signs in residential areas. He then left Pierre on Highway 34, at times driving 115mph.
Because of the habitual offender information, Howe, Jr., can be ordered to spend up to five years in the South Dakota State Penitentiary, rather than the maximum of two years for a Class 6 Felony. Sentencing is set for Dec. 6, 2022.
OCTOBER 27, 2022:
A Stanley County grand jury has indicted a 38 year old rural Harrold man on felony charges of 4th Offense DUI, Aggravated Eluding and several misdemeanor traffic offenses.
Stanley County States Attorney Tom Maher says the case against Fabian Wayne Howe, Jr., is being investigated by the South Dakota Highway Patrol and the Hughes County Sheriff’s Office. It’s being prosecuted by the Stanley County State’s Attorney’s Office.
Howe was arrested, then released on $2,000 cash bond.
