A Hughes County jury has found a 36 year old man from Pierre guilty of Aggravated Assault/Domestic Violence.
David Timmons’ trial concluded Friday (March 12, 2021).
State’s Attorney Jessica LaMie says the charge is a Class 3 felony. But, she says Timmons, a registered sex offender, plead “no contest” to an Attempted Fourth Degree Rape charge in 2015, increasing the the current guilty verdict to a Class 2 felony. The charge is punishable by up to 25 years imprisonment in the state penitentiary and $50,000 in fines.
Sixth Circuit Judge Bobbi J. Rank oversaw the trial and has tentatively set a sentencing date for May 10, 2021.
Assistant Attorney General Amanda Miller handled the prosecution and trial for Hughes County as COVID-19 restrictions had created an overflow of work for the Hughes County State’s Attorney’s Office.
