JANUARY 2023:
Chief Judge Roberto A. Lange, U.S. District Court has decided the penalty for a 38 year old man from Eagle Butte convicted of Possession With Intent to Distribute a Controlled Substance.
Allen Michael Garreau was sentenced to five years in federal prison, followed by four years of supervised release, and ordered to pay a $1,000 fine and a $100 special assessment to the Federal Crime Victims Fund.
Garreau possessed 77 grams of methamphetamine with the intent to further distribute that methamphetamine to individuals on the Cheyenne River Sioux Indian reservation and other locations in South Dakota.
This case was investigated by the Cheyenne River Sioux Tribe Law Enforcement Services. Assistant U.S. Attorney Meghan N. Dilges prosecuted the case.
MAY 2021:
A 37 year old man from Eagle Butte has been indicted by a federal grand jury for Possession with Intent to Distribute a Controlled Substance.
Allen Michael Garreau pled not guilty.
The Indictment alleges that on March 16, 2021, in Eagle Butte, Garreau did knowingly possess with intent to distribute 50 grams or more of a mixture or substance containing a detectable amount of methamphetamine.
The maximum penalty if convicted is a mandatory minimum of five years up to life in federal prison and/or a $250,000 fine, up to life of supervised release and $100 to the Federal Crime Victims Fund. Restitution may also be ordered.
Garreau was released on bond pending trial. A trial date has not been set.
