The South Dakota Supreme Court heard arguments this morning in Pierre (April 28, 2021) over the constitutionality of “Amendment A”– the measure that would legalize the possession, cultivation and sale of recreational marijuana in the state for those age 21 years and over starting July 1.
Some critics of the constitutional amendment have said people didn’t understand the question on the November 2020 ballot. But, South Dakotans for Better Marijuana Laws attorney Brendan Johnson said people knew what they were voting for.
Attorney Lisa Prostrollo represented Highway Patrol Superintendent Col. Rick Miller, who filed the lawsuit on behalf of Gov. Kristi Noem. Prostrollo says the lawsuit is about protecting the state constitution.
South Dakota is the first state to approve both recreational and medicinal marijuana on the same ballot and Johnson said people supported Constitutional Amendment A for a variety of reasons.
Prostrollo said the measure addresses multiple topics, which she argued is a violation of state law.
The Supreme Court Justices asked both attorneys questions throughout their arguments, but didn’t give a timeline as to when they’d issue a ruling.
