JULY 2022:
A man from Rosebud convicted of Assaulting, Resisting, and Impeding a Federal Officer has been sentenced by a U.S. District Court judge.
Todd Kal Wilcox, age 42, was sentenced to 25 months in federal prison, followed by three years of supervised release, and a special assessment to the Federal Crime Victims Fund in the amount of $100.
The conviction stemmed from an incident that occurred on July 15, 2021, in Todd County, South Dakota. On that date, a Rosebud Sioux Tribe Law Enforcement Services officer responded to a call for service to remove Wilcox from a residence for being under the influence and disorderly. The responding officer asked Wilcox to leave the residence, and the officer removed a vodka bottle from Wilcox’s person while escorting him outside. Wilcox thereafter became combative and threatened and assaulted the officer with a metal bar.
This case was investigated by the Rosebud Sioux Tribe Law Enforcement Services.
DECEMBER 2021:
A man from Rosebud has been indicted by a federal grand jury for Assaulting, Resisting, and Impeding a Federal Officer.
41 year old Todd Kal Wilcox pled not guilty.
The Indictment alleges that on July 15, 2021, in Todd County, South Dakota, Wilcox did assault, oppose, impede, intimidate, and interfere with a law enforcement officer who was employed by the Rosebud Sioux Tribe Law Enforcement Services, and that such conduct involved the use of a dangerous weapon.
The maximum penalty upon conviction is up to 20 years in federal prison and/or a $250,000 fine, three years of supervised release, and $100 to the Federal Crime Victims Fund. Restitution may also be ordered.
The investigation is being conducted by the Rosebud Sioux Tribe Law Enforcement Services. Assistant U.S. Attorney Abby Roesler is prosecuting the case.
Wilcox was released on bond pending trial.
