Acting United States Attorney Dennis R. Holmes says a Rapid City man has been indicted by a federal grand jury for Escape from Custody and Criminal Contempt.
36 year old David Low Dog pled not guilty.
The Indictment alleges that on May 21, 2021, Low Dog, who was on a temporary furlough, failed to comply with an order issued by the U.S. District Court and escaped from the custody of the U.S. Marshals Service from the Hughes County Jail in Pierre.
The maximum penalty upon conviction is up to five years in federal prison and/or a $250,000 fine, three years of supervised release, and $100 to the Federal Crime Victims Fund. Restitution may also be ordered.
The investigation is being conducted by the U.S. Marshals Service. Assistant U.S. Attorney Jay Miller is prosecuting the case.
Low Dog was remanded to the custody of the U.S. Marshals Service pending trial. A trial date has not been set.
