United States Attorney Alison J. Ramsdell announced that a Fort Thompson, South Dakota, man convicted of Assaulting, Resisting, and Opposing a Federal Officer has received his punishment.
Derek Kennedy, age 43, was sentenced to 45 days in federal prison and eight months of home confinement, followed by three years of supervised release. Kennedy was also ordered to pay a $100 special assessment to the Federal Crime Victims Fund.
The conviction stems from an incident that occurred on July 12, 2022, in Lower Brule. Kennedy was arrested for unrelated tribal offenses on the same date. As he was being booked into the Lower Brule jail, Kennedy became combative and attempted bite a federal officer on the arm and spit in the officer’s face.
This case was investigated by the Bureau of Indian Affairs – Office of Justice Service – Crow Creek Agency. Assistant U.S. Attorney Troy R. Morley prosecuted the case.
The defendant was immediately remanded to the custody of the U.S. Marshals Service to begin serving his sentence.
